Russell Hall and his Pinery 40 LLC purchased the 47-acre prairie property adjacent to the Colorado Horse Park [CHP]. They have submitted proposals for a “major rezone” to the current zoning. Currently this beautiful land is zoned for 15 Equestrian Estate properties on 2 ½ acres. Pinery 40 LLC wants to triple this number of houses (46-47 houses) and eliminate equestrian properties.

The Board of County Commissioners [BOCC] meeting is scheduled for 24 Sept @ 2:30pm.

1520 Major Amendment – Approval Criteria
“The following criteria shall be considered by the Board for approval of the major amendment.”

  • DCZR 1520.01 Whether the amendment is consistent with the development standards, commitments, and overall intent of the planned development.
  • DCZR 1520.02 Whether the amendment is consistent with the intent, efficient development and preservation of the entire planned development.
  • DCZR 1520.03 Whether the amendment will adversely affect the public interest or enjoyment of the adjacent land.
  • DCZR 1520.04 -Whether the sole purpose of the amendment is to confer a special benefit upon an individual.
  • DCZR 1520.06 – Whether the public facilities and services necessary to accommodate the proposed development will be available concurrently with the impacts of such development.
  • DCZR 1520.07 – Whether the roadway capacity necessary to maintain the adopted roadway level of service for the proposed development will be available concurrently with the impacts of such development.
